Referral Partner Terms & Conditions
These terms govern participation in the HostIQ Referral Partner Program. This document is a draft pending review by Ghana-qualified legal counsel.
Last Updated: September 2026
By submitting a referral or participating in the HostIQ Referral Partner Program, you agree to these terms. HostIQ may update these terms from time to time; the version in effect at the time of a qualifying referral applies.
Program Overview
The HostIQ Referral Partner Program allows individuals and organizations to introduce qualified prospects to HostIQ. When a referred prospect becomes a paying HostIQ client under the conditions below, the referring partner may earn a commission on the setup / implementation fee actually received by HostIQ.
Commission
Qualifying referrals earn a commission equal to twenty percent (20%) of the one-time setup / implementation fee actually received by HostIQ from the referred client. Commission is calculated on amounts received, not on quoted or invoiced amounts that are later reduced, refunded, or unpaid.
Excluded from commission
- Annual or monthly license or subscription fees
- Renewal fees
- Recurring software fees
- Third-party costs passed through to the client
- Taxes, levies, or government charges
- Any fee not explicitly classified by HostIQ as setup / implementation
When commission becomes payable
Commission becomes payable only after HostIQ has received the applicable setup / implementation payment from the referred client in cleared funds, and after any applicable cooling-off, refund, or chargeback period has passed without reversal. HostIQ will use reasonable efforts to pay qualifying commissions within a commercially reasonable period following receipt of client payment.
Qualifying referrals
- The prospect was introduced to HostIQ through a documented referral submission or other attributable introduction by the partner
- The prospect was not an existing HostIQ customer at the time of introduction
- The prospect was not already in an active HostIQ sales process before the partner's introduction
- The prospect signs a HostIQ client agreement
- HostIQ receives the applicable setup / implementation payment
Existing leads and attribution
Referrals of prospects who were already HostIQ customers, or who were already engaged in an active sales process with HostIQ before the referral, do not qualify. Where multiple parties claim credit for the same prospect, HostIQ will recognize the first qualifying, documented referral or determine attribution based on available evidence, including timing, completeness of introduction, and direct contact with the decision-maker.
Refunds and chargebacks
If HostIQ refunds or reverses any portion of a setup / implementation fee for which commission was paid or payable, the corresponding commission will be reduced, withheld, or clawed back proportionally.
Taxes
Partners are responsible for any taxes, withholding, or reporting obligations arising from commission payments in their jurisdiction. HostIQ may require tax identification or documentation before payment where required by law.
Partner conduct
- Partners have no authority to bind HostIQ, accept orders, or sign agreements on HostIQ's behalf
- Partners must not quote unauthorized pricing, discounts, or commercial terms
- Partners must not make misleading, exaggerated, or false representations about HostIQ
- Partners must submit referrals in good faith with accurate information
Prohibited referrals
- Self-referrals or referrals of businesses owned or controlled by the partner
- Fraudulent, fabricated, or duplicate submissions intended to manipulate attribution
- Referrals made in violation of applicable law or professional obligations
Termination
HostIQ may suspend or terminate a partner's participation in the program at any time for breach of these terms, fraudulent activity, or conduct harmful to HostIQ or its customers. Termination does not affect commission earned on qualifying referrals accepted before termination, subject to these terms.
Disputes
Questions about referral attribution or commission eligibility should be directed to HostIQ in writing with supporting documentation. HostIQ's determination of attribution and qualification, acting reasonably and in good faith, is final for program purposes.
Legal review
These terms are provided as a draft commercial framework. HostIQ recommends that partners and HostIQ obtain review by Ghana-qualified legal counsel before relying on these terms for tax, regulatory, or contractual purposes.
